Terms of Service

These Terms of Service ("Terms") govern your use of the REGRADE mobile application ("App") operated by REGRADE ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms.

Please also read our Privacy Policy, which explains how we handle your data.

1. What REGRADE Does

REGRADE is a camera application for iOS that captures photos and applies AI-powered film stock emulation. When you take a photo and choose a film stock, the App sends your image to our backend server, which uses the Google Gemini API to regrade it. The result is returned to your device.

REGRADE is a creative tool. The AI-generated regrading is an artistic interpretation, not an exact replication of any physical film stock.

You must sign in with Apple to use REGRADE. By creating an account, you confirm that:

3. Exposure Credits & Purchases

How Credits Work

Each photo regrading costs one exposure credit. You receive a limited number of free credits upon signup. Additional credits are available as in-app purchases in the form of "film rolls" (packs of exposure credits).

Refunds

Refunds are handled by Apple in accordance with their App Store refund policies. We do not process refunds directly. If you believe you were charged in error, contact Apple Support or request a refund through your Apple ID purchase history.

Credit Deduction

One credit is deducted when you initiate a regrading. If the regrading fails due to a server error on our end, we will attempt to restore the credit. Credits are not refunded if the result does not meet your aesthetic expectations, as regrading is a creative AI process with inherent variability.

4. Your Photos & Content

Ownership

You retain full ownership of the photos you take and the regraded results. We do not claim any intellectual property rights over your content.

By using the App, you grant us a limited, temporary license to transmit and process your photos solely for the purpose of performing the regrading service. This means:

5. Third-Party Services

The REGRADE name, logo, interface design, and all associated branding are the intellectual property of REGRADE. You may not use our branding without written permission.

The underlying technology, including our backend processing pipeline and film stock emulation prompts, is proprietary.

We aim to keep REGRADE available and functional, but we do not guarantee uninterrupted service. We may:

9. Limitation of Liability

REGRADE is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You agree to indemnify and hold REGRADE harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third party's rights.

If you have a dispute with us, please contact us first at contact@regradeapp.com. We will try to resolve it informally.

If we cannot resolve the dispute informally, it will be governed by the laws of France, without regard to conflict-of-law principles. Any legal proceedings shall be brought in the competent courts of France.

Nothing in this section limits your rights under mandatory consumer protection laws in your jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

If you do not agree to updated Terms, you should stop using the App and delete your account.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
